OVRSEE LLC, a Delaware limited liability company, doing business as "bored."
We respect copyright and expect people who use bored. to do the same. This policy explains how to tell us about content on bored. that infringes your copyright, how someone can dispute a takedown, and what happens to accounts that infringe repeatedly. It works alongside Section 4 (content licence) and Section 5 (copyright and the DMCA) of our Terms of Service.
1. Our policy in short
If you own a copyright and believe someone has posted your work on bored. without permission, you can ask us to remove it by sending a notice that meets the requirements below. If your own content was removed because someone reported it, and you believe that was a mistake, you can send a counter-notice. Accounts that repeatedly infringe copyright will be terminated.
2. How to send a takedown notice
Send your notice to our designated copyright agent (Section 6) by email. To be a valid notice under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), it must include:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed (or, if the notice covers multiple works, a representative list).
- Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it (for example, a profile link, a post, or a description specific enough for us to find it).
- Your contact information — at minimum, an address, telephone number, or email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
A notice missing these elements may not be actionable under the DMCA, and we may ask you to correct and resubmit it.
3. What happens after we receive a valid notice
We will remove or disable access to the reported material, notify the person who posted it, and give them the opportunity to send a counter-notice as described below. We keep records of notices and the action we took in response.
4. Counter-notice — if your content was removed by mistake
If material you posted was removed in response to a copyright notice and you believe it was removed by mistake or misidentification, you may send a counter-notice to our designated copyright agent. To be valid, it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the United States, any judicial district in which OVRSEE LLC may be found), and that you will accept service of process from the person who sent the original takedown notice, or their agent.
If we receive a valid counter-notice, we will forward it to the original complaining party. Unless that party informs us they have filed a court action seeking to restrain the person who posted the material, we may restore the material within 10 to 14 business days of receiving the counter-notice, as the DMCA allows.
5. Repeat infringers
We terminate the account of anyone who is the subject of three valid, unrebutted takedown notices within a 12-month period. We may also terminate an account for a pattern of infringement that falls short of that number, where the circumstances warrant it.

7. False claims
Misrepresenting that material is infringing, or that its removal was a mistake, can expose you to liability under 17 U.S.C. § 512(f), including for costs and attorneys' fees. Only send a notice or counter-notice if you believe, in good faith, that it is accurate.

2. Comment envoyer une notification de retrait
Envoyez votre notification à notre agent désigné en matière de droits d'auteur (Section 6) par e-mail. Pour être valable au titre du Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), elle doit comporter :
- La signature physique ou électronique du titulaire des droits d'auteur ou d'une personne autorisée à agir en son nom.
- L'identification de l'œuvre protégée dont vous estimez qu'il a été porté atteinte (ou, si la notification couvre plusieurs œuvres, une liste représentative).
- L'identification du contenu que vous estimez contrefaisant, ainsi que des informations raisonnablement suffisantes pour nous permettre de le localiser (par exemple, un lien de profil, une publication, ou une description suffisamment précise pour que nous puissions la retrouver).
- Vos coordonnées — au minimum, une adresse, un numéro de téléphone ou une adresse e-mail.
- Une déclaration selon laquelle vous croyez de bonne foi que l'utilisation du contenu n'est pas autorisée par le titulaire des droits, son représentant, ou la loi.
- Une déclaration, faite sous peine de parjure, attestant que les informations contenues dans la notification sont exactes et que vous êtes le titulaire des droits d'auteur ou autorisé à agir en son nom.
Une notification à laquelle il manquerait l'un de ces éléments peut ne pas être recevable au titre du DMCA, et nous pourrons vous demander de la corriger et de la soumettre à nouveau.
3. Ce qui se passe après réception d'une notification valable
Nous retirerons ou rendrons inaccessible le contenu signalé, en informerons la personne qui l'a publié, et lui donnerons la possibilité d'envoyer une contre-notification comme décrit ci-dessous. Nous conservons un registre des notifications reçues et des mesures prises en réponse.
4. Contre-notification — si votre contenu a été retiré par erreur
Si un contenu que vous avez publié a été retiré à la suite d'une notification de droits d'auteur et que vous pensez qu'il s'agit d'une erreur ou d'une mauvaise identification, vous pouvez envoyer une contre-notification à notre agent désigné. Pour être valable, elle doit comporter :
- Votre signature physique ou électronique.
- L'identification du contenu retiré et l'endroit où il apparaissait avant son retrait.
- Une déclaration, sous peine de parjure, attestant que vous croyez de bonne foi que le contenu a été retiré par erreur ou en raison d'une mauvaise identification.
- Votre nom, votre adresse et votre numéro de téléphone, une déclaration par laquelle vous consentez à la compétence du tribunal fédéral de votre ressort judiciaire (ou, si vous résidez hors des États-Unis, de tout ressort judiciaire où OVRSEE LLC pourrait être assignée), et par laquelle vous acceptez de recevoir la signification d'actes de la part de la personne ayant envoyé la notification initiale, ou de son représentant.
Si nous recevons une contre-notification valable, nous la transmettrons à la partie plaignante initiale. Sauf si cette dernière nous informe avoir engagé une action en justice visant à empêcher la personne ayant publié le contenu de le faire, nous pourrons restaurer le contenu dans un délai de 10 à 14 jours ouvrés à compter de la réception de la contre-notification, comme le permet le DMCA.
5. Infractions répétées
Nous résilions le compte de toute personne faisant l'objet de trois notifications de retrait valables et non contestées sur une période de 12 mois. Nous pouvons également résilier un compte pour un profil d'infractions répétées n'atteignant pas ce nombre, lorsque les circonstances le justifient.

7. Fausses déclarations
Le fait de déclarer faussement qu'un contenu est contrefaisant, ou que son retrait était une erreur, peut engager votre responsabilité au titre du 17 U.S.C. § 512(f), y compris pour les frais et honoraires d'avocat. N'envoyez une notification ou une contre-notification que si vous croyez, de bonne foi, qu'elle est exacte.
